President Donald Trump has signed an Executive Order (EO) proposing a 90-day suspension of visas and other immigration benefits to all citizens of seven Muslim countries. The unrealistic conditions required for discontinuing the suspension make it very likely that this EO will turn into a permanent ban.
Trump’s Muslim Ban is in Violation of the Constitution: One of the tenets upon which our country was founded is that religion is our own business and not the government’s. We have freedom of belief. Trump’s order is anathema to those founding principles. It violates the First Amendment’s Establishment Clause, which prohibits the government from preferring or disfavoring any religion. Trump’s anti-Muslim policy also violates the Equal Protection Clause: the part of the Fourteenth Amendment that guarantees that everyone is entitled to equal protection under the law.
This Executive Order imposes an undue burden on members of our community: The people whose status in the United States would be reconsidered under this EO are our students, friends, colleagues, and members of our communities. The implementation of this EO will tear families apart by restricting entry for family members who live outside of the US and limiting the ability to travel for those who reside and work in the US. These restrictions would be applied to nearly all individuals from these countries, regardless of their immigration status or any other circumstance. This measure is fatally disruptive to the lives of these immigrants, their families, and the communities of which they form an integral part. It is inhumane, ineffective, and un-American.
We are asking you to stop Donald Trump’s executive order to ban Muslim immigrants and refugees from entering the United States. This ban has caused global criticism, multiple protests and has left civil-servants in total discomfort.
For the past half of a century, the United States has prohibited any sort of discrimination that this travel ban has engaged in. As you stated yourself, this act is “mean spirited and un-American.” Change must happen.
No executive order, no matter how profound, can be self-executing. Every act requires the efforts of thousands of people to carry out. These people are civil servants, who are aware that this travel ban is illegal. As of January 30, only 8 Republican senators have opposed this ban. So, to the members of the senate, I am asking you to please look past politics and vote to reverse this executive order. Do not agree to violate the law or the constitution.
The president has overstepped his authority. He will not be a dictator. Donald Trump is changing the law rather than working within it. This EO is not valid and should be struck down as soon as possible. If we fail, this executive order will become a self-inflicting wound. Stand up with the rest of us, and help us reverse this order. The world is looking to you.
